These Terms & Conditions ("Terms") apply to all bookings and services ordered from or provided by HUMANS IN FLOW ("HIF", "we", "us", "our"). By booking, paying for, or participating in our services, you agree to these Terms.
1. DEFINITIONS
- Client / You: the person or legal entity purchasing services.
- Participant: the person who will use the VR headset and/or take part in an experience.
- VR Session(s): guided VR entertainment sessions and/or coaching toward autonomy (learning, installation support, content discovery, safe-use coaching), delivered by HIF.
- Signature / Immersion Day: a curated experience combining VR Sessions with non-VR services (e.g., venue, transport, catering, tastings, performers, accessories, wellness elements).
- Concierge Partner: a concierge company and/or third-party provider coordinating and delivering non-VR elements and often acting as the primary organiser for Signature / Immersion Days.
- Third-Party Provider: any independent supplier other than HIF providing goods/services (including Concierge Partners).
- Booking Confirmation: the email/message/invoice confirming the date/time, location, scope, and price.
2. SCOPE OF SERVICES
2.1 What we provide: VR facilitation and guidance, curated content selection, and when included VR headset(s), hygiene/disinfection measures, and on-site support during VR Sessions.
2.2 What we do not provide: We do not provide medical, clinical, or therapeutic services. Our services are for entertainment, educational, and well-being purposes and do not constitute medical advice, diagnosis, or treatment.
2.3 Signature / Immersion Days: Non-VR elements are provided by Concierge Partners/Third-Party Providers. HIF’s role is typically to deliver the VR component and accompany the group to support the flow of the experience.
3. ELIGIBILITY, CONSENT, AND SUPERVISION
3.1 Participants must be able to provide informed consent, or consent must be provided by a legal representative where appropriate.
3.2 For Participants with cognitive impairment, reduced mobility, balance issues, or relevant medical conditions, a caregiver/staff member should be present unless agreed otherwise in writing.
3.3 We may refuse, pause, or stop a session if we believe continuing is unsafe, if a Participant appears distressed, or if instructions are not followed.
4. VR SAFETY AND HEALTH WARNINGS
4.1 VR can cause discomfort in some individuals. Possible effects include motion sickness, dizziness, nausea, disorientation, eye strain, headache, anxiety, or (rarely) seizures.
4.2 A Participant should not use VR (or should stop immediately) if they:
- have a history of seizures/epilepsy or unexplained blackouts,
- have severe vertigo or severe motion sickness,
- are intoxicated, very fatigued, unwell, or distressed,
- have severe neck/back issues aggravated by head movement,
- experience chest pain, faintness, shortness of breath, or severe discomfort.
4.3 Participants must follow guidance, remain seated or reclining when instructed, and tell us immediately if they feel unwell.
4.4 We use reasonable hygiene and disinfection measures. If a Participant has a contagious illness, please notify us in advance so we can reschedule or adapt safely.
5. BOOKING, PRICING, AND QUOTES
5.1 Prices are those displayed on our website or agreed in writing (including Signature quotes).
5.2 Travel and additional equipment may be charged as described on our website or as agreed in the Booking Confirmation.
5.3 Signature / Immersion Days are quoted case-by-case. The Booking Confirmation will specify which elements are provided by HIF and which are provided by Concierge Partners/Third-Party Providers.
6. PAYMENT TERMS (INCLUDING SIGNATURE)
6.1 Standard HIF services: Unless agreed otherwise in writing, payment is due at booking or by invoice as stated in the Booking Confirmation.
6.2 Signature / Immersion Days (default model): For Signature / Immersion Days, the Client generally pays the Concierge Partner/Third-Party Provider(s) directly. The Concierge Partner is typically the primary organiser and invoices the Client for the overall experience and/or non-VR elements, and may also invoice for the VR element where agreed.
6.3 When the Client pays HIF directly: If the Booking Confirmation states that some or all amounts are payable to HIF (for example, VR Sessions only, or a separate VR fee), then those amounts are payable directly to HIF under these Terms.
6.4 Any bank fees or payment provider fees may be charged to the payer unless prohibited by law or agreed otherwise.
7. RIGHT OF WITHDRAWAL (EU/EEA CONSUMERS)
If you are a consumer booking at a distance (online/phone), you may have a 14-day right of withdrawal under applicable consumer rules, except where an exception applies (for example, services provided on a specific date/time or services fully performed with your prior express request).
Where you ask us to perform services within the withdrawal period, you acknowledge that you may be liable for a pro-rata amount for services already performed if you later withdraw, and that certain bookings may not be eligible for withdrawal where legally excluded.
8. RESCHEDULING, CANCELLATIONS, AND REFUNDS (48 HOURS)
8.1 Client cancellation/rescheduling of amounts payable to HIF:
- More than 48 hours before the scheduled start time: one reschedule without charge (subject to availability) or a refund of amounts paid to HIF, minus any non-recoverable costs already incurred specifically for your booking (if any).
- 48 hours or less before the scheduled start time (or no-show): amounts payable to HIF may be charged up to 100%.
8.2 Signature / Immersion Days paid to Concierge Partners/Third-Party Providers: Refunds, deposits, and cancellation policies for amounts paid to Concierge Partners/Third-Party Providers are governed by their terms and conditions. HIF does not control those policies.
8.3 Our cancellation/rescheduling: If we must reschedule due to illness, safety issues, equipment failure, or force majeure, we will offer a new date or refund amounts paid to HIF for the affected portion. Third-Party Provider refunds remain subject to their own terms.
9. LOCATION REQUIREMENTS AND PARTICIPANT CONDUCT
9.1 You must provide a safe environment suitable for seated/reclining VR use (stable chair/bed, clear space, appropriate lighting, and calm conditions where possible).
9.2 Participants must follow instructions. We may stop a session if instructions are not followed or if the environment is unsafe.
10. EQUIPMENT USE, DAMAGE, AND HYGIENE
10.1 Any equipment we bring remains our property.
10.2 If equipment is damaged due to misuse, negligence, or intentional acts, you agree to pay reasonable, evidenced repair or replacement costs.
10.3 We may refuse use if hygiene/sanitary conditions are unsafe or if there is a risk of contamination that cannot be adequately managed.
11. CONCIERGE PARTNERS / THIRD-PARTY PROVIDERS (RESPONSIBILITY AND INSURANCE)
11.1 For Signature / Immersion Days, non-VR services (transport, venues, catering, performers, tastings, wellness activities, etc.) are provided by independent Concierge Partners/Third-Party Providers.
11.2 Each Concierge Partner/Third-Party Provider is responsible for its own services, staff, safety, licensing, and insurance. Their own terms may apply and will govern their portion of the experience.
11.3 Unless the Booking Confirmation states otherwise, HIF acts as the provider of VR facilitation and may act as a coordinator/introducer for the overall concept. When the Client pays the Concierge Partner directly, the contract for non-VR elements is between the Client and the Concierge Partner/Third-Party Provider(s).
11.4 To the maximum extent permitted by law, HIF is not liable for acts, omissions, delays, failures, or cancellations of Concierge Partners/Third-Party Providers, or for any loss arising from their services.
11.5 Insurance position: Concierge Partners typically maintain insurance suitable for the activities and venues they coordinate. HIF may not hold standalone public liability insurance covering every location and every combined activity format at all times. This does not limit any liability that cannot legally be excluded.
12. LIABILITY AND LIMITATION
12.1 We will provide our services with reasonable care and skill.
12.2 You acknowledge that VR involves inherent risks (including discomfort such as dizziness or nausea) and agree that Participants will follow safety guidance and stop if symptoms occur.
12.3 To the maximum extent permitted by law, HIF is not liable for:
- indirect or consequential losses (loss of enjoyment, loss of opportunity, etc.),
- issues caused by incomplete/incorrect information provided by you,
- Participant non-compliance with safety guidance,
- incompatibility or failures of Client-owned equipment or networks when using Client equipment,
- Third-Party Provider services (see Section 11).
12.4 Non-excludable liability: Nothing in these Terms limits or excludes liability for:
- death or personal injury caused by negligence where such limitation is prohibited,
- fraud or fraudulent misrepresentation,
- any liability that cannot be excluded under applicable law.
12.5 Liability cap (3 months): Subject to Section 12.4, HIF’s total aggregate liability for claims arising out of or in connection with services payable to HIF is limited to the total amount you paid to HIF for the relevant services in the three (3) months preceding the event giving rise to the claim.
13. PHOTOS, VIDEOS, AND TESTIMONIALS
13.1 If photos/videos are offered as part of a Signature experience, recording will only occur with consent.
13.2 Any marketing use of images/videos requires separate consent. Refusal does not affect service delivery.
14. INTELLECTUAL PROPERTY
14.1 Our methodologies, session structure, written materials, and curated “Immersion Day” concepts remain our intellectual property.
14.2 VR content is typically owned/licensed by third parties. You receive no ownership rights and agree not to copy, record, or redistribute protected content.
15. DATA PROTECTION (GDPR)
15.1 We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable French data protection laws, as described in our Privacy Policy.
15.2 We may share limited personal data with Concierge Partners/Third-Party Providers only as necessary to fulfil a booking (e.g., names for reservations, accessibility needs, dietary constraints), and only in accordance with our Privacy Policy.
16. COMPLAINTS AND CONTACT
If you have a complaint or request support, please contact zander@humansinflow.global with details. Where possible, include the booking date, location, and a description of the issue.
17. CHANGES TO THESE TERMS
We may update these Terms from time to time. The version in force at the time of your booking applies to that booking.
18. GOVERNING LAW AND JURISDICTION
These Terms are governed by French law. Any dispute arising out of or in connection with these Terms is subject to the jurisdiction of the competent courts of Nice, France, subject to any mandatory consumer protection rules that apply.
